These terms cover the Talk Equalizer app on iOS and Android, and this website. If you obtain the app from the App Store or Google Play, the terms of that store apply as well. Apple and Google are not parties to this contract and are not responsible for the app. Where Apple requires it for apps from the App Store, Apple’s standard EULA terms apply.

2. Definitions

App means Talk Equalizer for iOS and Android, and this website where these terms mention it. A party is a shared session at a table. A participant is a person taking part in a party. A voice profile is the numeric signature made when someone sets up their voice. It is not a recording. Talk-time statistics are the figures and times the app shows about who spoke.

3. Contract and eligibility

The contract is formed when you download or use the app, or use this website. You must be at least 16. If you are younger, a parent or guardian must consent.

4. The service

The app is free. You can set up a voice, join a party with a QR code, follow the party live across phones, and see a final report on the phone. This version has no account and no sign-in. Features may change.

5. Your duties and consent to recording

You may record a conversation only after you have told everyone present and everyone has consented. Secret recording is not allowed. You must comply with the law of the place where you record. In Germany that includes § 201 of the Criminal Code. You will not use the app for surveillance, for employment decisions, or to evaluate people.

6. Prohibited use

You may not reverse engineer the app except where the law allows it, abuse the live sync, interfere with the service, or use it for unlawful content.

7. Availability and maintenance

We do not guarantee any particular uptime. Multi-phone sync needs an internet connection.

8. Intellectual property and licence

The app and this website remain our work. We grant you a non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial use.

9. Accuracy of the statistics

Talk-time statistics are estimates only. Do not base decisions about people on them.

10. Warranty

For this free use, the statutory rules apply, in particular the principles of §§ 516 ff., 521 and 524 of the German Civil Code. Where the rules on digital products apply, §§ 327 ff. of that code apply.

11. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and for a guarantee we have given. For slight negligence we are liable only for breach of an essential contractual duty, and only for foreseeable damage typical of this contract. Otherwise liability is excluded.

12. Data protection

Personal data is handled as described in the privacy policy.

13. Term and termination

You may stop using the app and uninstall it at any time. We may suspend access if you misuse it.

14. Changes

We may change the service and these terms. We will give notice in the app or on the website of a material change. You may object by stopping use.

15. Future paid features

If we later introduce paid features, separate terms will apply, and we will present them to you first.

16. Consumer dispute resolution

We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board. The European Commission’s online dispute resolution platform was discontinued in July 2025.

17. Governing law and jurisdiction

German law applies. The UN Convention on Contracts for the International Sale of Goods does not. If you are a consumer, the protections of the law of the country where you live remain. For merchants, the courts of Berlin have jurisdiction.

18. Severability

If a provision is invalid, the rest remains in force. The statutory rule takes the place of the invalid provision.
